Terms of Service

1. Overview
These Terms of Service (“Terms”) govern your use of Brandful’s design services (“Services”). By subscribing or using our Services, you agree to these Terms.
2. Services Provided
We offer on-demand design services via a monthly subscription. Plans may include a defined number of active requests, turnaround times, and collaboration tools (as outlined on our website). All work is provided digitally.
3. Subscription & Payments
Subscriptions are billed monthly in advance via [Stripe].
Your subscription automatically renews each month unless paused or canceled.
You may pause or cancel anytime before your next billing date.
We do not provide partial refunds for unused time within a billing period.
If a payment fails, access to design services may be paused until resolved.
4. Scope of Work
Design requests are handled one at a time, based on your plan’s capacity and turnaround time. Services include design work (UI/UX, branding, marketing assets, etc.), but do not include:
Web development or code implementation
Video production (unless specified)
Copywriting or marketing strategy
5. Ownership & Licensing
Upon full payment, you own all final design deliverables created under your active subscription.
Brandful retains the right to display work in portfolios or marketing materials unless you request otherwise in writing.
Source files (e.g., Figma, Adobe, or other formats) will be shared upon completion of each request.
6. Client Responsibilities
To ensure timely delivery, clients must:
Provide clear briefs, assets, and feedback promptly.
Maintain access to communication platforms (e.g., Notion, Slack, email).
Avoid abusive, inappropriate, or excessive demands outside the agreed service scope.
7. Turnaround & Revisions
Turnaround times depend on request complexity. Most requests are completed within 1–3 business days. Unlimited revisions are included for active requests, but large revisions may be treated as new tasks.
8. Confidentiality
We respect your confidentiality and will not disclose project details or materials to third parties. Likewise, you agree not to share internal processes, tools, or communication publicly without permission.
9. Termination
Either party may terminate service at any time.
Upon termination, outstanding payments remain due, and ownership of completed deliverables transfers once paid in full.
10. Limitation of Liability
Our total liability for any claim is limited to the amount you paid for Services in the past 30 days. We are not liable for indirect or consequential damages, including loss of profits or business interruptions.
11. Governing Law
These Terms are governed by the laws of Canada, without regard to conflict of law principles.
